LE-RU.NET operates a service which provides a high speed connection the the Internet and makes available its network and computer facilities to LE-RU.NET subscribers for all commercial and research uses. Subscribers certify that they are at least 21 years old and accept full responsibility for ensuring the legal use of this connection to the Internet. During normal usage of network resources, subscribers may utilize portions ot the Internet that restrict commercial or other traffic as per that portion of the Internet's own Acceptable Use Policy. All LERU.NET customers must agree to abide by all Acceptable Use Policies for any network that they traverse, and to always comply with local, state, and federal laws. Terms and Conditions:
- LERU.NET network services may only be used for lawful purposes. Transmission of any material in violation of any federal or state law or regulation is prohibited. This includes, but is not limited to: Material determined to be threatening or obscene, material that displays nudity, copyrighted material, or material protected as trade secrets. Customer agrees to indemnify and hold harmless LERU.NET from any claims resulting from use of the service which damages the customer of any other party.
- LERU.NET exercises no control over the content of the information passing through its network. LERU.NET makes no warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content of the information, products, or services it is providing. LERU.NET will not be responsible for damages that are incurred or suffered. This includes but is not limited to, loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or others' omissions or errors, and indirect or consequential damages of any character. Use of any information obtained via LERU.NET is at the user's own risk. LERU.NET specifically denies any responsibility for the accuracy or quality of information obtained through its services.
- Warranties on equipment and/or software purchased from LERU.NET are limited to the written limited warranty which accompanies that merchandise. All sales are final with no returns on equipment and/or software other than as stated. LERU.NET warranty obligation may exceed those stated in certain jurisdictions. LERU.NET will comply with all state and local regulations.
- Any liability of LERU.NET, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction; or unauthorized access to, alteration of, or use of records, whether for breach of contract, torturous conduct, negligence, or pursuant to any other cause of action, shall be strictly limited to the amount paid by or on behalf of the customer to LERU.NET for the current month.
- Users certify that they are at least 21 years old and accept full responsibility for ensuring the legal use of the Internet connections. Sublicensing, copying, duplication or resale of LERU.NET's networks and/or services without the express written consent and license of LERU.NET is strictly forbidden under all circumstances. Unauthorized use of LERU.NET's services, networks, eauipment, or lines is fraudulent, and charges equal to the prevailing charges for such usage will be billed.
- Users are allowed to run two(2) processes at a time, and may have up to two(2) stopped processes in the background. These processes may only be run while the user is logged in, provided that each job does not adversely affect system availability or response time. "Child processes" of programs made available by LERU.NET for use by its customers do not apply to this rule. Users should log off if idle for more than 12 minutes. This keeps the system load low, and improves the availability of services to other customers.
- Bulk mailings to more than 130 users from LERU.NET is prohibited. Users sending letters with more than 6 recipients must run consecutive mail delivery programs. Concurrent mailings to more than 6 recipients and unsolicited commercial mail to multiple recipients are not allowed. An individual dial-up account entitles only the named user to log in on one(1) TCP/IP connection at a time. (LERU.NET also offers dedicated connections and dedicated lines. Dedicated service accounts are not governed by the non-dedicated account usage policies of Paragraph 7, but are governed by all other AUP terms and conditions.)
- To open or close an LERU.NET account requires written notification by Fax, E-Mail, or US Mail. Phone requests require written confirmation. LERU.NET acknowledges receipt of requests to open or close an account by mail.Cancellation Requests Must be made before the next billing cycle. Any requests after billing are subject to that month's service fee. Accounts that remain unpaid after 10 days of invoice date may have their service interrupted. Such interruption will not relieve the customer from the obligation to pay monthly charges. If you default, you agree to pay LERU.NET reasonable collection expenses, including attorney and collection agency fees.
- LERU.NET will provide free installation under the following circumstances:
- (1) If a subscribers' house should burn, we will reinstall internet service in the subscribers new home if said service is available at the new location.
- (2) If a subscriber moves to a new location anytime during a two (2) year period after establishing service, LERU.NET will move said service for free to the new location, if service can be provided at the new location.
- This free move installation is limited to one move per 2 years, starting at the date of subscribers initial service.
- (3) LERU.NET will provide free service for marketing specials solely at the discretion of LERU.NET.
- LERU.NET reserves the right to modify, change and reformat the Acceptable Use Policy as it deems necessary, with notice to you, but without permission or consent of its network users.
- Parents, Guardians, and suprevising adults of children and dependents under the age of twenty-one are not permitted to allow access to their account by any minor children, unless LERU.NET is provided with proof of installation of an industry approved content blocking software package, i.e., Surf Watch, Net Nanny.
This Acceptable Use Policy and these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted. Use of LERU.NET's services, networks, and systems constitutes acceptance of these and any amended Terms and Conditions.
